General Conditions and Rules

These general conditions apply to all services provided by Joshua Nieli, unless otherwise agreed in writing.

1. Duties of the Therapist

The therapist is bound by a duty of confidentiality. All information shared by the client during sessions will not be disclosed to third parties without the client’s explicit consent, unless required by law.

The therapist handles all personal data with care and in accordance with applicable data protection laws. The client will be informed about the purpose of data collection, how the data is used, and with whom it may be shared.

Consultation with third parties (by telephone, in writing, or electronically) will only take place with prior consent from the client.

The therapist undertakes a best-efforts obligation to provide professional guidance and support. No guarantee of specific results is given. The client remains responsible for their own process and any outcomes resulting from the sessions.

During the intake, the therapist and client will work together to define the client’s needs and goals. Based on this, a guidance or treatment plan will be proposed and discussed. Upon agreement, the client commits to an initial series of five sessions, followed by an evaluation.

The therapist reserves the right to terminate services in cases of compelling reasons, including but not limited to aggressive or inappropriate behavior, lack of cooperation, repeated non-payment, or when the therapist determines that appropriate guidance can no longer be provided.

In case of illness or unforeseen circumstances, the therapist will inform the client as soon as possible and offer the option to reschedule.

The therapist maintains a client file as required by applicable laws. The client has the right to access their file upon request.

If the therapist determines that another form of guidance would be more appropriate, a referral may be recommended.

Client files are retained for the legally required period (typically 20 years).

2. Duties of the Client

The client is responsible for providing complete, accurate, and timely information necessary for the sessions.

Any consequences resulting from withholding relevant information are the responsibility of the client.

By starting the sessions after the intake, the client agrees to an initial commitment of five sessions, followed by an evaluation.

Appointments must be canceled at least 48 hours in advance via email or telephone. The time of receipt of the message is considered the time of cancellation. In case of late cancellation or no-show, the full session fee will be charged.

A guidance process is preferably concluded with a final session to ensure proper closure.

3. Payment Terms

The therapist applies different rates depending on the type and duration of the session. These will be communicated in advance.

Invoices are issued prior to sessions and sent by email. Payment must be made within 14 days of the invoice date. Online sessions must be paid in full before the session takes place.

If payment is not received within the specified period, a reminder will be sent. Continued non-payment may result in collection measures, with any additional costs borne by the client.

If payment obligations are not met, the therapist reserves the right to suspend further sessions, unless doing so would seriously interfere with the client’s well-being.

Short contact between sessions (by phone or email) is included up to 10 minutes. Additional time may be charged proportionally at the session rate.

Written reports requested by the client for third parties may be charged separately.

Situations of force majeure on the part of the client can be discussed with the therapist.

4. Health, Safety and Personal Responsibility

All services are provided as guidance, coaching, or therapeutic support and do not replace medical or psychological treatment.

The client is responsible for their own physical and mental health and is advised to consult a qualified professional where necessary.

Participation in sessions and any practices discussed is voluntary and entirely at the client’s own risk.

5. Substances and Psychedelics

Any information relating to substances is for educational or informational purposes only.

The client is fully responsible for complying with the laws and regulations applicable in their country or jurisdiction.

Any decisions regarding the use of substances are made entirely at the client’s own risk and responsibility.

6. Liability

Joshua Nieli is not liable for any direct or indirect damages resulting from the use of services, except where such liability cannot be excluded by law.

The client accepts full responsibility for their own choices, actions, and outcomes.

7. Final Provisions

These general conditions may be updated or modified at any time. The most recent version will always be available on the website.

In cases not covered by these conditions, the therapist will act reasonably and fairly in line with professional standards.
